oh my, i've been studying too long. or maybe law school really does change your thinking so you 'think like a lawyer.' i'm sitting in the couch, watching the national college dance team championships on ESPN. (the sports i watch on tv are limited to college basketball, cheerleading, gymnastics, and figure skating.) and i'm looking at the various teams who win and trying to figure out what it is the judges like- you know, searching for a coherent principle to organize a group of individualized, fact-based decisions- and the holding i come up with is that the court prefers groups who include a clip of outkast's song "bombs over baghdad" in their music. i then theorized that the policy explanation for this holding is that the song undeniably rules.
